Whilst the general public have a free right of passage over public highways, there is no general right to access your own property over land belonging to others.

When purchasing properties for our clients we carefully check all necessary legal means of access over land belonging to third parties. We check the purposes for which such access can be taken, the permitted hours of use, whether access with vehicles is permitted, or only on foot, etc.

For existing land owners we can negotiate new rights of way, variations to or surrenders of existing rights.

Where land is subject to public rights of way we can advise on the possibility of changing the location of such rights and the protection of land from misuse.

We also offer advice on maintenance of rights of way and the recovery of the costs of maintenance.
